A court has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The case stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an mistake. After his repatriation to the United States to face alien smuggling allegations, he was held in federal custody.
In her order, the judge pointed out that the authorities does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
The court proceedings involve conflicting assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this claim.
He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in the state of Tennessee.
The court, who was hearing his challenge to removal in a Maryland district court, ruled that he must now adhere to the terms of his release from custody in Tennessee. This order shifts his supervision to the Tennessee court.
